Birbflow Subscription Terms

By purchasing a subscription from Birbflow, you agree to the following terms and conditions.

1. Subscription Type and Minimum Term

The Birbflow subscription is a recurring monthly subscription with a minimum term of three (3) subscription payments.

This means that after your initial purchase, you commit to a total of three (3) monthly payments. Your first payment is made at checkout, followed by two (2) additional monthly payments.

One (1) product delivery is made per payment, shipped to the address provided at checkout.

After the third payment has been processed, the subscription continues on a month-to-month basis until cancelled.

2. Billing Dates and Payments

Your first payment is charged immediately at checkout.

All subsequent payments are charged monthly in advance on the same calendar day of each following month as your initial purchase (your "billing date").

If your billing date does not exist in a given month, the payment is charged on the last day of that month.

Example: A subscription purchased on March 10 is charged on March 10, April 10, and May 10. A subscription purchased on January 31 is charged on January 31, February 28 (or 29 in a leap year), and March 31.

By subscribing, you expressly authorize Birbflow to automatically charge your selected payment method for all subscription fees, shipping costs, and applicable taxes, on a recurring basis, until the subscription is cancelled in accordance with these terms.

3. Cancellation During the Minimum Term

You may submit a cancellation request at any time, including immediately after your initial order.

A cancellation request submitted during the minimum term takes effect once the third (3rd) payment has been processed and the corresponding delivery has been fulfilled. The subscription will continue to bill and deliver until all three (3) payments are complete, after which it terminates automatically and no further charges are made.

You do not need to submit a second request — one cancellation is sufficient.

4. Cancellation After the Minimum Term

Once the minimum term of three (3) payments is complete, the subscription:

  • terminates automatically if a cancellation request has already been submitted, or
  • continues month-to-month if no cancellation has been submitted.

After the minimum term, you may cancel at any time. To avoid being charged for the next cycle, your cancellation must be submitted at least three (3) days before your next scheduled billing date. Cancellations submitted within three (3) days of the billing date take effect the following cycle.

No partial refunds, credits, or prorated charges are issued for a billing period that has already begun.

Cancellation is confirmed by email. If you do not receive a confirmation within two (2) business days, please contact us so we can resolve it.

6. Address and Customer Information

You are responsible for keeping your shipping and contact information accurate and up to date. Changes must be submitted before the next billing and shipping cycle to take effect for that cycle. Birbflow is not responsible for delivery failures resulting from incorrect or outdated information provided by you.

7. Shipping, Delivery and Risk of Loss

Delivery dates are estimates and are not guaranteed. Risk of loss and title pass to you upon handover of the shipment to the carrier. Birbflow is not responsible for delays, losses, or delivery failures caused by third-party carriers, customs authorities, or events beyond its reasonable control.

8. Prices and Taxes

The subscription price, the recurring billing amount, the billing frequency, and any applicable shipping costs are displayed at checkout before you complete your purchase. By completing checkout, you expressly agree to these amounts.

Prices are exclusive of applicable sales tax, which is calculated and displayed at checkout based on your shipping address where required.

9. Product Availability and Substitutions

Birbflow may substitute a product of equal or greater value, or delay, reschedule, or cancel a delivery, in the event of product unavailability, supply chain disruption, or other operational constraints. Where a delivery is cancelled and not substituted, the corresponding payment will be refunded or the billing cycle extended accordingly.

10. Changes to the Subscription Program

Birbflow may modify, suspend, or terminate the subscription program, its pricing, or these terms.

Changes to the recurring price or to these terms will be communicated to active subscribers by email at least thirty (30) days before they take effect. You may cancel before the effective date if you do not agree to the change. Continued participation after the effective date constitutes acceptance.

Birbflow may terminate a subscription immediately in the event of payment failure, suspected fraud, abuse, or material breach of these terms.

11. Warranties

Except as expressly stated in these terms and to the maximum extent permitted by applicable law, products are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. Nothing in these terms limits any rights you have under applicable consumer protection law.

12. Limitation of Liability

To the maximum extent permitted by law, Birbflow shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, loss of data, or loss of use.

Birbflow's total liability arising out of or relating to the subscription shall not exceed the total amount paid by you during the three (3) months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

13. Force Majeure

Birbflow shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including natural disasters, pandemics, labor disputes, supply chain disruptions, governmental actions, war, or transportation failures.

14. Chargebacks and Payment Disputes

If you have a problem with a charge, please contact us first at support@birbflow.com — most issues are resolved within one business day.

Unauthorized chargebacks, payment disputes, or reversals may result in immediate suspension or termination of the subscription. Birbflow reserves the right to recover any fees, costs, or losses incurred as a result.

15. Severability

If any provision of these terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.

16. Survival

Provisions relating to payment obligations, limitation of liability, governing law, jurisdiction, and dispute resolution survive termination or cancellation of the subscription.

17. Entire Agreement

These Subscription Terms constitute the entire agreement between you and Birbflow regarding the subscription and supersede all prior communications, representations, or agreements, written or oral.
